What is PoSH Act 2013 ?
As a responsible employer in India, ensuring a safe and respectful workplace is paramount. The PoSH (Prevention of Sexual Harassment) Act of 2013 provides the framework for this. It mandates the formation of an Internal Committee (IC) in every organization with 10 or more employees. This committee is crucial for addressing and resolving complaints of sexual harassment, fostering a culture of trust and accountability within the company. Why do PoSH Compliance through PoSH Training?
There are two aspects for doing PoSH Compliance (1) To comply with the PoSH Act 2013 of Government of India and (2) For safety of employees and reduced employer responsibilities

1. To Comply with PoSH Act 2013
- β It is a legal mandate under The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.
- π¨ Non-compliance can lead to penalties, including: βΉ50,000 fine for the first offence. Higher fines or cancellation of license/registration for repeated violations.
- ποΈ Mandatory during audits and inspections (including labor law, CSR, or company law audits).
- π Essential for company filings and statutory declarations, such as annual reports and disclosures under the Companies Act.
- βοΈ Avoidance of legal liability in case of a sexual harassment complaint.
- π Protection from vicarious liability (employer held responsible for employee actions) if due process isnβt followed.
- π Scrutinized during external accreditations, e.g., ISO, SA8000, ESG assessments, and due diligence by investors.

PoSH Act and Internal Committee
Formation of Internal Committee (earlier Internal Complaints Committee – ICC) is mandatory as per the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 β commonly called the PoSH Act, 2013.
- PoSH Act, 2013 β [Act No. 14 of 2013], notified on 22 April 2013, effective from 9 Dec. 2013.
- The Internal Committee requirement is under Section 4 of the Act.

There are at least 10 mandatory requirements under the PoSH Act 2013.
Some of these are,
- Every employer must provide mechanisms to prevent sexual harassment.
- A complaint mechanism must be set up, headed preferably by a woman and involving third-party NGOs or other bodies.
- Disciplinary action must be taken against offenders.
- Ensure employee awareness of their rights.
- Strict confidentiality must be maintained.
What if You Ignore? i. e. non-compliance
Non-compliance penalty
- 1. A penalty of up to INR 50,000/- for non-compliance
- 2. Where an employer repeats a breach under the act, they shall be subject to,
- a) Twice the punishment or higher punishment if prescribed under any other law of same offence
- b) Cancellation/withdraw/non-renewal of registration/license required for carrying on business or activities.
